A man, who along with his father and two other family members was accused of harassing his wife for dowry, has been acquitted by a Delhi court which said the woman had made vague and unspecific allegations against them.
Metropolitan Magistrate Vandana Jain, while acquitting Sunil Sharma and other family members, said the woman made unspecific allegations regarding cruelty committed by them and she had not stated anything to support the prosecution case.
"The ingredients to hold the accused persons invoke, section 498-A IPC (husband or relative of husband of a woman subjecting her to cruelty) are not present in the evidence of the prosecution. Therefore accused persons are acquitted for the offence charged under section 498-A of IPC," the magistrate said.
"In the testimony of the complainant, no specific demand is alleged to to have been made by any of the accused persons. No incident has been enumerated as to how and by whom the demand was made and what was demanded...The allegations are vague, unspecific and undated in nature," it said.
Sunil, along with his father Shambhu Nath Sharma, brother -in-law Puran Chand Sharma and sister-in-law Lata Sharma was booked by the police under IPC for subjecting his wife to cruelty and harassment and demanding dowry.
According to the prosecution, Kamal Jeet Kaur was married to Sunil, a resident of Delhi, in 2007. After their marriage, her husband, father-in -law and other family members started demanding dowry from her.
She conveyed the demand to her parents and her mother arranged Rs 10,000 and brought her to the matrimonial home, it said.
Later, again a demand was raised and when the same could not be fulfilled, she was allegedly beaten up and the accused tried to kill her. Thereafter, she was thrown out of the house, according to the prosecution.
Kamal Jeet filed a complaint with the police and an FIR was lodged against all the accused.
During the trial, Sunil and his family members had pleaded not guilty and said they were falsely implicated in the case as Kamal Jeet allegedly had an eye over their property.
