Drunk driver is like "live suicidal human bomb", says Court

A drunken driver is just like a "live suicidal human bomb", a Delhi court has observed while upholding a six-day jail sentence awarded to a man for drunken driving.

Additional Sessions Judge Lokesh Kumar Sharma passed the order dismissing an appeal filed by Badarpur resident Jogi Varghese against the trial court order sentencing him to six days in jail and a fine of Rs 2,000.

The sessions court said the man was not entitled to any leniency as the trial court had rightly opined that the alcohol content found in his blood was 42 times more than the permissible limit when he was riding a two wheeler.
 

"In my opinion, the appellant while riding the two- wheeler scooter under such heavy intoxication, was just acting like a live suicidal human bomb, who could have taken the lives of others while driving the said vehicle in such a state of mind and it could have also proved fatal for him as well, due to a slightest mistake committed by him on road.

"Hence, in the given set of facts and circumstances, the appellant is not entitled to any leniency of this court... No ground warranting an interference of this court in the exercise of its appellate powers and jurisdiction is made out. Accordingly, appeal is dismissed," the judge said.

The court ordered the man to be taken in custody to serve the sentence.

Varghese was convicted by the trial court on December 21, last year under the provisions of the Motor Vehicles Act.

His driving licence was also cancelled for six months by the trial court which directed him to undergo fresh driving competency test.
