The Lucknow Bench gave breather to the senior IAS officer on a writ petition filed by him yesterday.

Justice Shabihul Hasnain passed the order while disposing of the petition filed by Singh, who had held the charge of principal secretary (home) during the Mayawati regime.

While appealing for the retention of the house the IAS officer submitted that as he was transferred on April 2, he may be allowed to retain it for seven months from the date of transfer as per a government order.

Senior counsel Jaideep Narain Mathur appeared for Singh.

Singh requested the court that his son was appearing in different examinations, one of which was scheduled to be held on May 20.

He has also requested that any change of place at this juncture will mentally disturb his son and may jeopardise his study. His mother is also ill and his father is very old, the court said.

The senior counsel Mathur later made a statement that if he is allowed time his client would vacate the premises latest by May 31 and handover peaceful possession of the same to the estate department.

"Since the statement has been made by a senior advocate on behalf of a senior officer, this court relies upon and honours the undertaking," the bench said.

Singh was shifted from the post as member judicial in board of revenue Allahabad immediately after SP government came to power.
