Police today filed an additional affidavit in the Madurai bench of the Madras High court opposing transfer of investigations into two explosions reported at Nelpettai here on November 20 last year and and March 14 this year from Vilakuthoon police to the (CBI).
City Police Commissioner Sanjay Mathur in his affidavit said cases had been registered by the jurisdictional police and there was no need to transfer them.
He also criticised the petitioner A Syed Abdul Kathar for illegally securing copies of two letters written by the Superintendent of Police, Madurai to the IG of Police.
The petitioner had not obtained the letters by invoking the provisions of the RTI Act. He had obtained the letters by illegal means. "This shows he has approached the court with unclean hands. That itself is enough to quash the plea", the counsel for Mathur submitted.
As explosions were sensitive matters involving terrorist elements, the petitioner was not entitled to receive copy of the letters.
Petitioner was not entitled to discretionary jurisdiction of this court, he contended.
He said the petitioner's allegations were general and sweeping in nature and no locus standi.
In his earlier counter affidavit Mathur had denied allegations of the petitioner that "police officers were playing a vital role in planting bombs in the district" besides acting in a manner prejudicial to a particular community. The charges levelled by the petitioner were defamatory in nature.
"Such allegations are being made only to divert genuine and bold officers from performing their duty. No personal or hidden agenda exists in police investigation.
