The family members of a 58-year- old man, who died after being hit by a rashly driven truck, have been awarded a compensation of Rs 5 lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed the National Insurance Company Ltd, insurer of the offending truck, to pay Rs 5,00,248 to the family members of north-west Delhi resident Govind Ram Arora who died in a road accident in 2008.
"Nothing is shown on record if the deceased was driving his two-wheeler scooter in a rash and/or negligent manner or that the said accident occurred due to fault of deceased and it is rather shown on record that R4 (driver) was driving the offending vehicle in a rash and/or negligent manner and caused the accident wherein the deceased lost his life," MACT presiding officer Barkha Gupta said.

Due to the impact, Arora along with his son fell down and sustained injuries. He was rushed to a nearby hospital where doctors declared him brought dead.
In their petition, the family members claimed that Arora was a property dealer who was also working as accountant. They had sought compensation to the tune of Rs 20 lakh.
The driver and the owner of the vehicle, in their written submissions, denied the rash and negligent aspect.
The insurance company had also submitted that the accident took place due to negligence of the deceased himself.
