Filling of vacancies for disabled: HC orders issue of notice

The Madras High Court today directed the government to file a reply with regard to steps taken to fill up backlog vacancies for persons with special needs.

A PIL was filed by Tamil Nadu Association for the Rights of All Types of Differently Abled and Caregivers (TARATDAC) which sought a direction from the court to quash an advertisement issued by the Teachers Recruitment Board (TRB) on July 14 for direct recruitment of BT Assistants-2012-13, which they said was against the provisions of recruitment for persons with special needs.

The TARATDAC submittd that there are 1107 backlog vacancies to be filled for through the TRB.
 

In order to protect interest of persons with disability, Parliament has enacted Persons with Disabilities (Equal Opportunity) Protection of Rights and Full Participation Act, 1995 providing for three per cent reservation for persons with disabilities in education, employment and other opportunities.

Even the Madras High Court had passed interim orders directing the government to fill up the backlog vacancies of disabled.

The TRB issued the advertisement without complying with the these orders for filling up the vacancies, the petitioners said.

The bench comprising Chief Justice Sanjay Kishan Kaul and justice M Sathyanarayanan also directed the government pleader to file reply within two weeks.
