TDI Infrastructure Ltd has been asked by a consumer forum here to pay Rs 3.5 lakh to a woman for deficiently cancelling the registration of a flat.
New Delhi Consumer Disputes Redressal Forum, presided by C K Chaturvedi, asked the firm to pay money to Delhi resident Stuti Jain, noting that in many other similar cases also, the firm was deficient and indulging in unfair trade practices.
"We have considered the similar case of Opposite Party (firm) in many other cases, where the Forum has held that OP is deficient in indulging in unfair trade practices by taking money and issuing further demand without allotment, for priority in allotment and forfeiting 50 per cent of deposit while returning it.
"The OP cannot demand anything before allotment of house nor it can cancel it, without allotment, nor it can demand more money for priority in allotment, once it has booked registration, on certain terms, which does not mention priority allotment etc," it said.
While holding the firm guilty deficiency, forum directed TDI to pay the money to Jain.
Jain had told the forum that she had deposited Rs 3,00,000 in February for a booking of a flat. The firm was supposed to alot flat number within six months.
However, instead of making an allotment first, the firm stated that as per policy 50 per cent was being refunded as the registration has been cancelled for not making payment despite demands, she said, adding that she had not received any such reminders.
The firm, however, contended before the forum that Jain was not a consumer but investor and that no deficiency was caused by it.
The forum, however, asked it to pay back the deposited amount to Jain and also a compensation of Rs 50,000.
