The order was passed by Judicial Magistrate Mirza Zeenat while hearing the CBI application seeking a 10-day remand.
On Monday last, Shukla was remanded in 14-day judicial custody till May 21.
The court fixed May nine as the next date of hearing.
The CBI had arrested former CMO Shukla on Sunday night in connection with the murder of his predecessor Arya in October 2010.
Shukla was arrested by the CBI last year in connection with the NRHM scam but was granted bail by the Allahabad High Court.
