The Allahabad High Court today directed the CBI to file a counter affidavit on a petition filed by a former project engineer of Noida Authority, who has challenged proceedings initiated against him by a lower court in a multi-crore-rupee tender allotment scam.
A Division Bench comprising Justice A K Tripathi and Justice D S Tripathi asked the investigating agency to file its reply on the petition by Vimal Kumar Manglik, who has sought quashing of proceedings initiated by the special CBI court at Ghaziabad, which has also issued a non-bailable warrant (NBW) against him.
The court, however, declined to interfere in the NBW issued by the lower court and directed Manglik to appear before it within two weeks.
Manglik had alleged that while the charge sheet against him was filed by the CBI "contrary to the law", the court had issued the NBW without a summons order and that he came to know about the warrant only through newspaper reports.
Manglik is among the co-accused in the scam along with the infamous former engineer-in-chief of Noida Authority Yadav Singh, who has been accused of owning properties worth nearly Rs 1000 crore, hugely disproportionate to his known sources of income.
