"Issue notice to the respondents (Delhi government and GGSIU)," a bench of Acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw said, but refused to stay the admission process.

The bench, which was hearing the PIL filed by NGO Image Society seeking directions to the university to not to award the seats meant for SC/ST and OBC students to general category admission seekers, fixed the matter for further hearing on September 5.

The court, while refusing to stall the admission process at the GGSIU said, "Why we should stop it at the last stage? Tomorrow is the last date. You can succeed next year. No student is before us. Let, some seats go to general category students."

The NGO told the court that the seats meant for reserved category, which remain vacant after the second counseling, should be first offered in an open house counseling to the SC/ST/OBC students and it should not be converted into general category seats as being done presently by the university.

"Direct the respondent number two (GGSIU) to not to convert the reserved category seats into general category during second counseling till the reservation policy is formulated," the petition said.

Presently, the university is conducting counseling for admission in various streams including BBA, LL.B after the Common Entrance Test held in April.
