The District & Session Court held the hospital administration responsible of the death of the child and passed the decree jointly against the state government, Secretary (Medical & Health), district collector along with the hospital.

It also directed them to pay the entire legal expenses of the petitioner who lost his child right from the date of filing of the petition along with the interest of 6 per cent.

Petitioner Rajuram's wife Guddi had delivered a baby in Umaid Hospital on November 23, 2009, which was bitten by a rat on the night of November 27 in the ward.

Petitioner's counsel Firoz Khan told the court that despite bringing the issue to the notice of the hospital administration, the doctors did not show any seriousness and the condition of the infant turned serious forcing the hospital to shift the baby to the ICU, where he succumbed on December 24.

"The hospital administration ruled out rat bite as the cause of death but admitted that the infant suffered from the neo-natal septicemia," Khan said.
