Acting on the recent guidelines issued by the Supreme Court regarding children of women prisoners, Gujarat High Court today took up a suo motu PIL and issued notice to state government.

The division bench of acting Chief Justice V M Sahai and Justice R P Dholaria sought a reply from the government on the steps taken to ensure that children of women prisoners living in jail get proper food, education, medical help and recreation facilities.

The Supreme Court has asked all the high courts to examine the situation of children of undertrials or convicted women prisoners who live with their mothers.

"A child shall not be treated as an undertrial/convict while in jail with his/her mother. Such a child is entitled to food, shelter, medical care, clothing, education and recreational facilities as a matter of right," a guideline of the apex court said.

Next hearing is scheduled for February 12.
