One Nanubhai Sheikh had approached the high court demanding cancellation of bail of Chaudhary, a BJP MLA from Radhanpur.

Justice A S Dave rejected the application saying there was no need to cancel the bail of Chaudhary at this stage.

The court, however, ordered the police to provide protection to all the witnesses in the case.

Chaudhary's lawyer submitted that his client has not breached any condition of the bail. Chaudhary was immediately granted bail after his arrest in the case in 2005.

In the case, Chaudhary and 11 others have been accused of killing two minority community members on March 1, 2002, in Radhanpur of north Gujarat. The police had lodged a case of rioting against 12 accused in the case.
