Guj HC reserves order on petn accusing BJP MLA of misbehaviour

The Gujarat High Court has reserved its order on a petition which alleges that BJP MLA from Matar misbehaved with a lady deputy superintendent of police in Kheda district of the state and seeks a probe into the incident.

Justice J B Pardiwala of the High Court, earlier this week, reserved the order after the arguments were over.

The petition has been filed by Raman Makwana of Malawada village in Matar tehsil.

According to the petition, some houses belonging to the members of Dalit community were burnt and atrocities were committed in the village by members of another community last month.
 

Following which, police arrested 18 persons. When the lady DySP in charge of the SC-ST cell was taking the 18 accused to Matar court, BJP MLA Kesarisinh Solanki intercepted the vehicle and misbehaved with her demanding release of the accused, the petition says.

The DySP appeared before the court last month and confirmed the incident. She also said that the MLA threatened her saying that the accused persons were his men.

She had informed the District Superintendent of Police in Kheda but filed no written complaint, she said.

The High Court took a serious note of this, observing that "if the allegations are believed to be true, it not only amounts to behaviour unbecoming of a representative of people, but it would also constitute offence under section 186 of the Indian Penal Code for obstructing a public servant in discharge of his official duty."

The MLA, on the other hand, said in his affidavit filed yesterday that he did not misbehave with the lady police officer, but had only stopped the police vehicle.
