The Uttarakhand High Court today abrogated the provision for free holding of nazul land by illegal occupants.

Declaring the statutory provisions on the matter as unconstitutional, a division bench of justices Rajiv Sharma and Lokpal Singh also slapped a fine of Rs 5 lakh on the State government.

The bench held that more than 20 thousand acres of nazul land is being occupied illegally by occupants in the state.

The high court gave its ruling on a plea challenging the provisions of Nazul Land Policy 2009 which entitles an illegal occupant to get the land freehold in his favour.
