Madras High Court today allowed the mother of a Vanniyar caste girl whose marriage to a Dalit boy sparked off clashes, to withdraw the Habeas Corpus petition she had filed alleging that her daughter had been illegally detained by her husband's family.
A bench comprising Justices M Jaichandren and M M Sundresh observed that petitioner N Thenmozhi, mother of N Divya, cannot be denied permission to withdraw the petition in view of the fact that her daughter has declared she was returning to her mother voluntarily.
The bench rejected the plea of the parents of E Ilavarasan, demanding a probe into circumstances of death of the girl's father and also her husband, besides into her statements.

Ilavarasan's body was found along the railway track in Dharmapuri on July four and Divya's father Nagaraj committed suicide last year after her marriage to the Dalit boy.
"It is not for this court to conduct an elaborate and detailed enquiry into the various circumstances that had culminated in the death of Nagaraj and in respect of the unfortunate demise of Ilavarasan, in the present proceedings. It is for the authorities concerned to cause an enquiry to find out the truth," the bench further observed.
Thenmozhi filed the HCP alleging that her daughter was being kept in Elavarasan's home against her wishes.
