HC allows petition by contractors

The Madras High Court has admitted a petition praying to quash a tender notification clubbing all the major and small works with regard to the contracts of road laying and other related works.

Justice R Subbaiah on petition filed by Tamil Nadu Highway Department Contractors Welfare Sangam, Chennai, directed the Special Government Pleader R Sanjay Gandhi yesterday to file counter within a week and posted the matter for further hearing to February 18.

The Association submitted that the re-introduction of "package system" was followed by the authorities and in the tender notification dated January 12, also some confusion created between the contractors and the authorities, like the authorities did not follow the Act and Rules contemplated under the Tamil Nadu Transparency in Tenders Act.
 

The Association stated contract to the value from Rs 5 crore to Rs 15 crore as a single package includesof various road works and other works and it will cause delay in completion of the projects and hence theymoved the court to quash the above notification which was issued as a single package work.

They submitted the court to direct the authorities concerned to split the works and issue tender notifications which will benefit both the small contractors as well as the public.

The association contended said that if it was given separately, the small contractors will also get the work and the projects will be completed within the time frame.
