HC asks Realtor to pay Rs 75K to wife, daughter as maintenance

A real estate businessman has been directed by the Delhi High Court to pay Rs 75,000 every month to his wife and 11-year-old daughter towards their maintenance in a matrimonial dispute case.

The court also directed the man, a leading construction firm promoter, to provide a mid-segment AC car with a driver to them for their day-to-day use and accepted the realtor's offer to bear all the expenses incurred towards their medical treatment and his daughter's studies.

"Considering the entirety of the circumstances, I am of the opinion that at this stage, a direction for monthly maintenance of Rs 75,000 payable in advance by the 5th day of every succeeding English calendar month, would subserve the purpose," Justice Rajiv Sahai Endlaw said in a recent judgement on the wife and daughter's joint plea.
 

The court directed the business man to pay the amount in two weeks with effect from January 2013.

The court, however, declined the woman's plea to grant Rs 5 lakh per month as maintenance saying "Though, the plaintiffs (wife and daughter) have claimed a sum of Rs 5 lakhs per month, but there is nothing before me to show the need of the plaintiffs being for the said amount or the lifestyle being led by them to be in consonance with the said demand."

Accepting the offer made by the businessman to bear all the expenses for their medical treatment and also the study of his daughter, the court said "The defendant (businessman) is also directed, as offered by him, to pay directly to the school of the plaintiff No. 1 (daughter) all dues whatsoever relatable to her, including towards any excursion and/or other activities which she may undertake...."

"He is further directed to bear all medical expenses of both the plaintiffs (wife and daughter), of whichever clinics/hospitals they may choose, by making payment directly to the said clinics/hospitals....," the court said.
