HC asks woman police officer to appear before Raj House panel

A single bench of Justice Mohammad Rafiq dismissed the petition filed by Ratna Gupta but asked the state legislative assembly to maintain magnanimity in the matter specially looking to the fact that the officer is a woman.

The bench observed, "If the petitioner appears before Secretary, Rajasthan Legislative Assembly on October 29 and further submits to the jurisdiction of the privilege committee as and when required the assembly must re-consider the need of issuing arrest warrants to summon the official."

Gupta was alleged by the Assembly to have committed breach of parliamentary privilege on July 19, 2010 during the visit of a Child and Women welfare committee of state assembly to Police station Mahila (East) where she was posted as SHO.

 

When the woman officer was called upon to show some investigation records of a case she refused to follow the directives and insulted the MLAs, sources claimed.

Gupta was served with a show cause notice thrice by legislative privilege committee to show cause as to why she should not be punished for the breach of parliamentary privilege but when she failed to appear a warrant of arrest was also alleged to have been issued by the House.
