The Karnataka High Court today cancelled the allotment of discretionary quota sites to K H Muniyappa, Union Minister of State for Micro, Medium and Small Scale Enterprises, observing that it was an "illegal" allotment.

A Division Bench headed by Chief Justice D H Waghela was disposing of a PIL filed by advocate D V Chandrashekhara Reddy.

The petition filed on November 27 last alleged that Muniyappa along with many other persons had amassed huge amounts of wealth disporportionate to their known sources of income.

The petitioner stated that Muniyappa, was elected to Lok Sabha continuously from Kolar (reserved) constituency, in Karnataka right from 1999 to 2009.

"It is also learnt from reliable sources that Muniyappa and many others have been beneficiaries of "G" category (discretionary quota) sites", the petitoner stated, adding he had filed applications under the RTI Act to obtain details of illegal allotments made to several persons who are elected representatives and had sufficient material in this regard.

The petitioner had alleged that Bangalore Development Authority had allotted sites bearing No 566,567 measuring 60 ft x 80 ft in Katriguppe, Banashankari Stage 3, under "G" Category to Muniyappa on July 22, 2002, while he was a Lok Sabha MP.

He claimed that the present market value of the sites allotted to Muniyappa was over Rs 2 crore and it was allotted at subsidised rates for paltry sum of Rs 7,51,825 though the market value at the time of allotment was Rs 24 lakh.
