HC CJ recuses from hearing plea for recalling Puducherry LG

The First Bench of the Madras High Court headed by Chief Justice Indira Banerjee today transferred to a division bench a PIL seeking a direction to the Centre to recall Puducherry Lt Governor Kiran Bedi.

Recusing herself from the case, Justice Banerjee observed that occasions may arise and she may be in touch with the Lt Governor in Raj Bhavan in her official capacity frequently and it may not be proper to hear the petition.

The first bench comprising the chief justice and Justice Abdul Quddhose posted the matter before the division bench of justices CT Selvam and N Sathishkumar.
 

The petition was filed by T Murugan, Puducherry CPI state committee member.

The petitioner alleged that right from the date of assuming the Lt Governor's office, Bedi never respected the Constitution of India "by recognition of separation of powers" and the procedures prescribed under it.

Murugan alleged that Bedi interfered with the judiciary, the legislature and the executive and sought a direction to the Union home ministry for recalling her.
