The division bench of Justice D N Patel and Justice Prashant Kumar delivered the verdict after earlier reserving it on September 6.

While reserving the order, the bench had observed that the case of Brijendra Kumar, who had beheaded Khusboo in the campus of a reputed college here when she was coming out from an examination hall on April 27, 2011, was not the rarest of rare and that the convict was young with no criminal history.

Kumar, who had been overpowered by other students and handed over to the police after the beheading, had moved the high court against a trial court pronouncing capital punishment on him.
