HC declares election of Independent MLA illegal

The Patna High Court today declared election of an Independent MLA Somprakash Singh as illegal on the ground that his resignation from government service was not accepted during poll time in 2010.

A single bench court of Justice Navaniti Prasad Singh disqualified Somprakash Singh as MLA from Obra Assembly seat in Aurangabad district.

The order came while hearing an election petition of the unsuccessful JD(U) candidate Pramod Singh Chandravanshi.

The petitioner had submitted that Singh's resignation as Sub Inspector of Police was not accepted by the government during his filing of nomination and also declaration of results in last Assembly poll in 2010.
 

The Obra MLA is among four Independents who had extended support to Chief Minister Nitish Kumar after split of NDA.

Singh could not be reached for comments.
