A Division Bench comprising Justice D P Singh and Justice Anurag Kumar dismissed a writ petition filed by Chaudhary in which he has challenged the FIR registered on June 2. The FIR named him along with more than 100 people for allegedly instigating communal violence which claimed four lives in Kosi Kalan.
Chaudhary was the Minister for Agriculture in the BSP government while his brother Lekhraj, who has also been named in the FIR, is a member of the State Legislative Council.
The court said "from the perusal of the FIR, prima facie it cannot be said that no cognizable offence is made out. Hence, no ground exists for quashing of the FIR or staying the arrest of the petitioners".
However, the court added "in case the petitioner surrenders before the Magistrate concerned, their bail may be considered expeditiously, if possible, on the same day".
