HC directive to TNHB

Court today directed the Tamilnadu Housing Board to ensure that it followed rules and regulations while construcing block of flats.

Justices R.Sudhakar and V.M.Velumani gave the direction to the Executive Engineer of the board on a petition from R Nagarajan.

The petitioner had submitted that the board was building a multi-storeyed building in Madakulam village without obtaining Plan approval from the local planning authority and sought to restrain it from putting up unauthorised constructions.

Petitioner had submitted that the government organisation itself was not following rules and regulations and sought a direction to the Member Secretary of Local Planning Authority to initiate action against the officials concerned.
 

The Judges said the apprehension of the Petitioner appeared to be in good faith.

The Secretary of the LPA should inspect the building and take action if there were violations.

As the issue had been brought to the notice of the officials,they should act promptly,in accordance with law and avoid untoward incident as in Moulivakkam in Chennai, where an under construction building collapsed claiming 61 lives last year, the judges said.
