HC directs police to submit call details

The Madras High Court today directed police to submit all mobile call details of ten persons suspected to be involved in the kidnap and murder of a real estate dealer and managing trustee of K M Allaudin Rowther Dharma Trust.

Justice Kirubakaran of the Madurai bench of the court also directed police to secure the closed circuit TV footage at the sub-registrar's office at Arasaradi where the group allegedly forced the victim K Jamal Mohammed to sign three sale deeds and power of attorney deed for a 1.64 acre property, worth Rs 30 crore, at Arapalayam in the heart of the city.
 

The petitioner, Jainab Beevi, wife of the deceased, sought a direction to transfer the case to the CBI as, according to here, police were allegedly trying to protect the real accused.

The petitioner submitted that Jamal Mohammed managed to cancel the 'patta' issued to one Ganesan and 13 others who encroached Trust Land by producing valid documents.Ganesan got angry with Jamal Mohammed, and it was against this background he went missing from this August 31, she submitted.

The petitioner alleged that he went in the car of one Sithik alias Mohammed Sithik and was later kidnapped, but police had not traced the car or Sithik,though a complaint was lodged.

The Inspector of Tallakulam, who registered the complaint, did not take any step to trace the kidnappers or the victim, the petitioner alleged.

The petitioner charged that though she listed names of the suspects who kidnapped her husband, police suddenly came up with the news that one Sankar kidnapped Jamal Mohammed and murdered him over a dispute over sharing the brokerage.

The Inspector informed her that the body of her husband was found near Perumal Malai at Kodaikanal.Police did not permit the family members near the body when the post mortem was conducted, the petitioner alleged. Different versions were being given regarding the murder.

The petitioner said if the call details were examined, the real culprits could be nabbed. She sought a direction for producing video footage of the post-mortem and CCTV footage of proceedings at the sub-registrar office when the registration was done on September one.

The judge admitted the petition.
