HC dismisses another plea against DMK, AIADMK candidates

The Madras High Court today dismissed with cost yet another petition challenging the acceptance of nomination papers of AIADMK and DMK candidates in the Aravakurichi assembly constituency election slated for tomorrow.

A bench comprising Chief Justice Sanjay Kishan Kaul and Justice R Mahadevan imposed a cost of Rs 3,000 while dismissing the petition by A P Geetha of Desiya Makkal Sakthi Katchi, a candidate in the election.

The court noted that the matter of acceptance of nomination of the AIADMK and DMK candidates had already been raised in different proceedings and the court had answered this question in view of the Election Commission having accepted the nomination and allotted the symbol.
 

"We find, thus, such repeated endeavours a complete wastage of judicial time and consider it as a fit case where not only the petition should be dismissed but also cost should be imposed on the petitioner," the bench held.

Contending that the Election Commission had earlier annulled the election to Aravakurichi constituency in May due to malpractices allegedly adopted by DMK and AIADMK nominees K C Palanisamy and V Senthil Balaji, the petitioner said the EC ought to have rejected their nomination for the current election.
