The Madurai Bench of the Madras High Court today dismissed the appeal filed by the Secretary of the Tourism and Hindu Religious and Charitable Endowment Department challenging the Single Judge's order to give posting to a Joint Commissioner and pay his withheld salary within two weeks.
Justice V Ramasubramanian and Justice V M Velumani while passing the orders on a contempt of court petition cautioned that if its order was not implemented it would direct the respondent official to appear before it and alsoalso imposed Rs 10,000 as cost on the Secretary.
The petitioner R.Sudarshan submitted that he was relieved of his duties while he was working as Joint Commissioner at the Tiruchendur Sri Subramaniaswamy temple on February 11, 2013. His salarly for the month of February remained upaid so far and was kept waiting for posting.

Justice D.Hariparanthaman had observed that the Petitioner should have been given posting in some other place and salary for February 2013 for which the official was entitled to and the petitioner filed the contempt of court petition after the Single Judge order was not honoured.
The Secretary in his appeal challenging the Single Judge order contended that the Joint Commissioner had been kept under Compulsory wait for Administrative Convenience.
The government would assign the posting at an appropriate time, he submitted.
The Petitioner had not reported before the appropriate authority for postings as prescribed by the Government order, the Secretary contended.
