HC dismisses petition against Assam BJP MLA

The Gauhati High Court today dismissed a petition against BJP MLA Kishor Nath alleging adoption of corrupt practices in the 2016 assembly polls.

Nath was elected from Borkhola in Cachar district.

Independent candidate Misbahul Islam Laskar had also prayed for recounting of votes under the provisions of the Representation of the People Act, 1951.

Justice Arup Kumar Goswami allowed Nath's contention and rejected the petition holding that there is no ground of corrupt practice as well as for recounting of votes of the winning candidate.

The court dismissed the petition and in its verdict elaborately discussed various judgments passed by the Supreme Court and the Gauhati High Court.
 

Nath had filed an interlocutory application for striking out pleadings of the election petition and also for its rejection.

Senior advocate B D Das along with H K Sarma and R Deka argued on behalf of Nath, while advocates E A Ahmed and N H Laskar appeared for the petitioner.
