HC disposes Pipili PIL, victim's treatment to continue

The high court categorically asked the state government to continue providing the best available treatment to the 19-year-old victim at the SCB medical college and hospital since she was shifted there for the second time in January this year.

        The HC also gave liberty to the petitioner advocate Prabir Das, a social activist, to approach the court in case he felt any negligence towards the victim during her treatment at the government hospital.

        When brought to its notice that there were some murmurs about the manner in which the crime branch police was probing the case, the division bench of Chief Justice V Gopla Gowda and Justice S K Mishra ordered that any grievance with regard to police investigation should be brought to the notice of the trial court which should redress them on merit.         The crime branch police have filed four chargesheets against eight people, including a dismissed police inspector and three doctors before a court in Pipili.

 

While four persons have been arrested till date, the policeman and doctors have not been taken into custody.         Taking note of the status report filed by the investigating police officer, the high court wanted to know why the dismissed policeman and doctors were not arrested.

The IO stated that he was reasonably satisfied with the manner in which the government officials were cooperating in the investigation.

The IO stated that since the offences for which they were booked invite simple imprisonment of less than one year, he did not arrest them on the basis of section 41 of CrPC.    

The police, however, have kept the investigation open as they were waiting to record statement of the victim, who is in a comatose state.
