Calcutta High Court today extended the stay of a single bench order that directed a CBI investigation into the Parui murder case till the court reopens after holidays next month.

After hearing submissions by the state government which had challenged the single bench decision, the division bench of Justice Jayanta Biswas and Justice I C Das directed that the stay on CBI probe be extended till October 27 when the court re-opens after Durga Puja and Diwali holidays.

Kalyan Banerjee, Trinamool Congress MP and the state's advocate in the case, pleaded before the bench that CBI probe is ordered when the investigation is not done properly or is done under extraneous influences.

There is no evidence of either, he said and urged the court to cancel the CBI probe order.

West Bengal government had last week filed the appeal challenging the single judge order.

Justice Harish Tandon had on Wednesday directed the special investigation team(SIT) headed by West Bengal DGP to hand over all materials related to the case to CBI expressing displeasure at the role of the top policeman and the way the probe was handled by the SIT.

The case pertains to the murder in Birbhum district of Sagar Ghosh, who had in 2013 fought panchayat elections as an independent candidate in West Bengal.
