HC full bench hearing on PMC Commissioner inconclusive

The full bench hearing of Patna High Court on the suspension of Patna Municipal Corporation(PMC) Commissioner remained inconclusive today.

Full bench comprising Acting Chief Justice Iqbal Ahmad Ansari, Justice V N Sinha and Justice Navniti Prasad Singh heard the matter related to suspension of the PMC Commissioner by the state government.

A division bench of Justice V N Sinha and Justice Prabhat Kumar Jha of the court had on Tuesday ordered continuation of the stay on suspension of Patna Municipal Corporation(PMC) commissioner till a final verdict.

The suspension matter along with two PILs on PMC was referred to a the full bench of the HC yesterday by the Acting Chief Justice after it came to light that his court and that of Justices Sinha and Jha had given 'conflicting' views on the matter.
 

The court of the acting chief justice, before whom the state government had brought before it the matter on December 15 that PMC Commissioner had been suspended and Ashok Kapil had been given the task, had said that suspension matter could not be decided on a PIL.

But, the division bench which heard the PMC Commissioner on the same day took strong objection to the suspension despite its staying the transfer of the official which was also affirmed by the Supreme Court.

Senior advocate Y V Giri, who appeared for PMC today as Additional Advocate General Lalit Kishore was removed by the corporation yesterday, in his argument questioned setting up of a larger bench on the matter.

The large bench is constituted to resolve some constitutional matter or interpret law which was not the case in the present matter, he said.

The court arose from the case without giving any verdict today.
