The Madras High Court has issued a notice to the Tamil Nadu DGP on a criminal original petition filed by a doctor seeking a court-monitored CBI probe into what he termed bigamous marriage of his wife to a person who he claimed was an associate of a state minister.
Justice R.S. Ramanathan, before whom the petition filed by Dr Senthil Kumar of Guyana came up yesterday, ordered issue of the notice to the DGP.
The petitioner's counsel submitted that a case was registered at the Kallakurichi police station on June 27,2013 based on his complaint to the DGP, the Home Secretary and the SP Villupuram on May 28 of that year.
In his complaint, the petitioner had said he got married to R Padmavathi on November 22, 2004. He filed for divorce in a Coimbatore court as his wife, who went to her parents house when he went abroad, refused to join him. While it was pending, she got married to another person on May 5, 2013, he had said.
Police, who took up the investigation, did not inquire the complainant or collected any materials but filed a report with "fatal irregularties" which made him file the present criminal original petition.
The investigation officer had not met the petitioner nor his father and no records such as videos were seized. Not a single witness to the alleged bigamous marriage was examined, and even the signed complaint has not been brought on record, it was alleged.
The petitioner alleged that the groom was an associate of the minister even before the latter became a minister.
The minister and MLA, who had allegedly participated in the marriage function, were also not examined, the petitioner claimed and sought a court-monitored investigation by CBI.
