HC junks PIL on keeping CJ out of selection of Lokayukta

The Allahabad High Court today dismissed a PIL challenging a bill passed by Uttar Pradesh legislature amending Lokayukta Act excluding the Chief Justice of the Allahabad high court from the selection committee related to selection of the Lokayukta.

A division bench of Justices Dinesh Maheshwari and Rakesh Srivastava passed the order on a PIL filed by NGO "We The People" through its general secretary Prince Lenin.

The bench termed the PIL as premature.

The petitioner sought a direction to quash the Uttar Pradesh Lokayukta and Up- Lokayukta (Amendment) Bill, 2015.

On behalf of the state government, Additional Advocate General Bulbul Godiyal opposed the PIL contending that it was premature hence it was liable to be dismissed.
 

"Having regard to the circumstances, we permit the petitioner to withdraw from this petition. So far as the prayer for liberty is concerned, when this petition is premature one, there does not appear any reason to extend any such liberty," it observed.

"However, it is made clear that any future petition in regard to the present subject matter shall be considered on its own merit in accordance with law," the court said.

The court said that the PIL stands dismissed as withdrawn with the observations forgoing.
