HC notice to Paraskar on petition seeking cancellation of bail

The Bombay High Court today issued a notice to the suspended Deputy Inspector General of police Sunil Paraskar on a petition seeking quashing of the anticipatory bail granted to him in a case against for alleged rape.

A Mumbai-based model, who had filed a case of rape against Paraskar earlier this year, has filed the petition.

Justice Sadhana Jadhav issued the notice to Paraskar and posted the petition for arguments on December 3.

A special women's court had granted anticipatory bail to Paraskar three months ago.

The petitioner alleges that Paraskar has violated the bail conditions and even threatened her lawyer.
 

She also says that the lower court's order wrongly casts aspersions on her character.

Someone on behalf of Paraskar threatened her lawyer, asking to withdraw from the case and offering a bribe of Rs 10 lakh, the petition says.

The special judge has "offered protection to Paraskar by presuming the applicant's character to be suspect and thereby negating all her allegations as false and void", it says.

"Abuse of alcohol, presumption of consent and inability to control sexual desires cannot be used as an excuse to shift liability and responsibility to the victim of rape," the petition says.

According to her complaint with the police, Paraskar molested and sexually assaulted her on two occasions in December 2013. She had met him first in 2012 when he was Additional Commissioner of Police with regard to a case, she says.
