HC notice to police on minor boy, father's plea to quash FIR

The Delhi High Court today sought police response on a plea for quashing of an FIR, lodged against a retired IAF officer for alleged sexual abuse of a minor boy in February after the parties claimed to have settled the issue out of court.

Issuing a notice to the Delhi police, Justice Sunil Gaur sought the response by July 19 on the joint plea of the complainant boy, his father and the accused person for the quashing of FIR which was lodged under the Protection of Children from Sexual Offences Act.

"Quash the FIR and proceedings arising out of the same pending before the court as petitioners (the victim and his father) have amicably settled their dispute," the plea said.
 

According to the plea, the victim's father works as dhobi in the group housing society where the accused stays in Dwaraka area.

The victim, a class-XI student, had gone to the accused person's house to hand over the ironed clothes where he was sexually abused by the accused in the lift on February 7, 2013, the petition said.

Following the complaint, the accused was arrested and a few days granted bail by the court.

Claiming that the victim, his father and the accused persons have settled the issue on February 23, the plea said "the incident took place due to misunderstanding with no intention to cause any harm on the accused who is a heart and sugar patient...The petitioners (victim and his father) agreed to withdraw their complaint/case against the accused.
