Madras High Court today ordered issuing of notice on a petition seeking to register an FIR on a complaint of insult to the national flag committed by Young Men India Association on the Independence Day.
On a petition filed by S Ragu, a member of YMIA, Justice P Devadoss ordered for issuing of notice returnable by a week to North Beach Police.
The petitioner said that the national flag was flying in half mast on the top of YMIA administrative building at Armenian Street here on August 15 this year.
Despite having brought to the the knowledge of the organisers of the function, the manager did not even respect the objection, the petitioner claimed.
He also said that some flowers were placed on the top of the flag mast inside the building, which would amount to an insult to the national tricolour.
Raju further alleged that at the time of flag hoisting, instead of playing or singing the national anthem, YMIA played some other song which was irrelevant.
He further contended that all the incidents amounted to dishonouring the national tricolour, which hurt his sentiments and was a punishable offence under Section 2 of the Prevention of Insults to National Honour Act, 1971.
The petitioner has also sent a report to police regarding the incident on August 17.
Since not even an FIR was registered, the petitioner moved the High Court praying to direct police to register FIR on the complaint sent by him.
