Madras High Court today directed Inspector of Police, All Women Police Station, Denkanikotta in Krishnagiri district to show cause in writing why a case relating to gang rape of deaf and dumb girl should not be transferred from their file.

Justice T S Sivagnanam, on a petition by the father of girl who was gang raped by unidentifed persons on December 25 last year, in his order observed "it is seen that the investigation is not proceeding in the right direction. The relevant IPC provisions have not been included in the FIR and there has been gross violation of the relevant provisions of Protection of Children from Sexual Offences Act-2012"

"In the light of the contentions raised by the petitioner the police is directed to show cause in writing by January 29 as to why the case should not be transferred from the file of All Women Police Station, Denkanikotta.", the Judge said.

The case relates to gang rape of the girl after beating her in the head with a log by the gang. She was admitted to a hospital at Denkanikotta. She later identified the four persons involved in the crime.

When the father of the girl went to the All Women Police Station to give complaint, they refused to take complaint citing absence of an Inspector of Police and only an entry was made that the girl was admitted in the hospital.

However, after agitations by All India Democratic Women's Association and Tamil Nadu Association for the Rights of All Types of Differently Abled the father and the girl were taken to Hosur in the guise of a Medical Test but were taken to the All Women Police Station at Hosur at Midnight on the New Year day.

There the Girl was subjected to harassment by police officials. In the mean time the heads of four villages of surrounding area has ex-communicated the family of the victim girl for not settling the issue.

Hence the father of the girl approached the High Court with a prayer to transfer the investigation on both gang rape and ex-communication of his family to the CBI.
