HC permits IRS officer to obtain custody of son

The Delhi High Court today allowed an Indian Revenue Service officer, facing prosecution in a harassment case, to obtain custody of his minor son living in Rajasthan for 15 days and directed the police there to facilitate the same.

Justice Gita Mittal, however, refused to go into the entire plea of Pramod Kumar Bajaj, who had moved the high court against the conditions imposed upon him by a trial court here while granting him bail in the case of allegedly harassing one of his wives.

The court issued notice to Delhi Police and sought its response by July 7 on Bajaj's plea.
 

Bajaj, posted in Uttar Pradesh, is accused of threatening his third wife who has filed a harassment case against him.

The trial court in its May 5 order gave him a chance to reform by not cancelling his bail for allegedly threatening the woman, whom he had fraudulently married during subsistence of an earlier marriage.

The trial court, however, had imposed several conditions on Bajaj and violation of any of them could lead to his bail being cancelled.

One of these conditions was that he would not get in touch with any of the witnesses, including his ex-wife who stays in Rajasthan with their minor son.

In his plea, challenging some of the bail conditions, he has sought permission of the high court to meet his ex-wife to obtain custody of his son.

He has submitted that the Allahabad High Court had granted him custody of his son for 15 days and added that the boy's vacation would get over on July 7 after which the child would have to attend his school.

The trial court in its May 5 order had observed that if his bail was to be cancelled his former wife would have to face hardships as she is getting maintenance from him and it would be stopped if he goes to jail.
