The Madras High Court Monday quashed the charge sheet framed against MDMK leader Vaiko for alleged offences under the Unlawful Activities (Prevention) Act in 2007.
Justice Anand Venkatesh passed the order on a plea moved by Vaiko assailing the charge sheet on the file of the XII Metropolitan Magistrate Court here.
According to the petitioner, on November 3, 2007 LTTE political wing leader Suba Tamilselvan was allegedly killed by the Sri Lankan military.
Condemning the killing, he along with Pazha Nedumaran organised a procession in the city.
Denying permission for the procession, Vaiko and 261 others were arrested by the police.
Vaiko was charged for offences under the Act and police filed a charge sheet before the magistrate concerned on December 11, 2009.
The petitioner contended that the sanction granted by the state to prosecute him under the Act was defective.
Near perusal of the sanction letter dated August 31, 2009 clearly shows that the procedure prescribed under the law was not followed in sanctioning the prosecution, Vaiko said.
