Madras High Court today quashed an order passed by Committee of Private Schools Fee Determination in respect of collection of excess fee with regard to the fee fixed by Anglo Indian schools for extra amenities provided to their students.
First bench comprising Chief Justice Sanjay Kishan Kaul and Justice T.S. Sivagnanam quashed the June 17 last order of the committee dated 17/06/2015 on a petition filed by Stanes Anglo-Indian Higher Secondary School.
"We are of the view that the occasion for the committee to exercise any jurisdiction has not ever arisen and thus the impugned order in respect of collection of excess fee is quashed," the bench said.
The bench then directed the Inspector of Anglo Indian Schools to pass an order in accordance with law within two months from today and to place the order before the Fee determination committee.
