The Kerala High Court today set aside a state government order cancelling the lease hold right of an estate situated in ecologically-sensitive Nelliampathy in Palakkad.
A division bench comprising Justice Antony Dominic and Justice Shaji P Chaly allowed the appeal by Joseph and Company which claimied lease hold right over the Beatrice Estate land for 99 years.
The land was leased out for 99 years in 1953. It was auctioned to one P J Joseph who sold it to the present lease holder K K Jospeh.

It prompted the government to cancel the leasehold alleging violation of lease conditions in the agreement.
The matter went upto the the Supreme Court which directed the government to take a fresh decision.
But the government maintained the earlier stand which was challenged before a single judge of the high court who upheld it.
The company filed the appeal against the single judge's order which was allowed by the division bench.
