HC quashes NSA detention of four

Madras High Court bench here today quashed detention of four persons under the National Security Act (NSA) on charges of attempt to murder a BJP functionary in Nagercoil in April last.

Allowing the habeas corpus petitions (HCPs) of the four, Justice S Nagamuthu and Justice T Raja held Tamil Nadu Government violated Sec 3(5)of the NSA, according to which a report should be sent to the central government together with the grounds on which the detention order has been made against the detenus.

The Bench accepted their contention that there was delay in sending the report to the Central Government.
 

Earlier, Additional Advocate General K Chellapandian told the court that there was no delay in sending the report.

Shaji,26, Prabhu alias Hamsa alias Abdul Azeez, 25, Abdul Sameem, 24, and Mohammed Shalin, 31, were arrested by police on various dates in April this year in connection with various offences including attempt to murder BJP functionary M R Gandhi, who was injured, in Nagercoil on April 21.

Following their arrest, the Kanyakumari District Collector had on May 21 passed orders detaining them under the NSA.
