Taking strong exception to unauthorised constructions in Sainik Farms here, the Delhi High Court today rapped the South Delhi Municipal Corporation (SDMC) for "blatantly' allowing them to come up.
"This is blatant. What are your officers doing? Not a brick was supposed to go inside Sainik farms. Have you taken action against erring officials?" a bench of justices Badar Durrez Ahmed and Siddharth Mridul said.
The high court's observation came after satellite images of 24 properties in Sainik Farms showing structural changes were shown to it.
The high court had during the last hearing directed the SDMC to take action against 24 properties in Sainik Farms here which according to the city government show structural changes despite a court order banning the entry of construction material in that area.
During the hearing, the SDMC informed the bench that out of 24 properties, 15 unoccupied properties have already been demolished and show cause notices issued to remaining nine property owners.
The bench asked Additional Solicitor General (ASG) Sanjay Jain to file an affidavit indicating the position of the Centre on the issue of unauthorised construction in Sainik Farms and fixed the matter for next hearing on December 3.
The bench also directed the society representing of Sainik Farm's original allottees - former Army personnel--to make their representations before the Centre within one week while directing the Centre to expeditiously decide on the representation.
The society, which represents around 45 former army officers who are original allottees and have residences there, had contended that they can't be held accountable for any new constructions in that area which are unauthorised.
It also submitted its members have been living in the area since 1950 and they are being continously "defamed" for living unauthorisedly.
