The Delhi High Court today refused to grant any interim relief to former Union Health Minister Anbumani Ramadoss who sought stay of the proceedings before a trial court in two corruption cases filed against him by CBI.
While declining to pass any interim orders, Justice Suresh Kait issued notice to CBI and sought its reply on Ramadoss' plea which pressed for quashing of the charge sheet and FIR against him as well as the trial court order on framing of charges.
Interim relief for stay of proceedings before the trial court was opposed by CBI's counsel, Rajdipa Behura, who said that the trial court judge has rightly ordered framing of charges against the former Union Minister.
The court has asked the CBI to file the counter affidavit within four weeks, while listing the matter for February 3, next year, for further hearing.
The trial court had on October 7 said that prima facie various offences including criminal conspiracy, cheating and forgery under the IPC and other provisions of Prevention of Corruption Act relating to public servant abusing official position were made out against Ramadoss and several others.
The trial court had said that the Pattali Makkal Katchi (PMK) leader had "criminally conspired" with other accused and abused his authority.
In his plea, Ramadoss has claimed that the charge sheet was rewritten and evidence was planted at later stage.
He also said that during order on framing of charges, he was charged under various new offences, which was not even mentioned in the charge sheet.
The counsel for the leader claimed that he was not given opportunity to be heard on the new charges found against him at the stage of framing of charges.
The trial court had fixed November 2 for formal framing of charges against the accused in both the cases.
Ramadoss was the Union Health Minister from May 2004 till April 2009 in the UPA-I government.
The two graft cases relate to alleged favours shown by Ramadoss and other accused to a private medical college, Rohilkhand Medical College and Hospital (RMCH), Bareilly, in Uttar Pradesh and Indore-based Index Medical College Hospital and Research Centre (IMCHRC).
