A Division Bench, headed by Chief Justice Vikramajit Sen, rejected the contention while hearing a PIL filed by one Natesh challenging the June 23,2009 order of the then governor Rameshwar Thakur in absolving Dharam Singh in relation to Lokayukta interim report on illegal mining.

The Lokayukta report, which indicted Singh, had asked the state government to recover Rs 23 crore losses allegedly caused by Singh in taking certain decisions on permitting mining activity in some areas.

Thakur had dropped the action against Singh when the state was under President's Rule,

The court will hear the PIL from July 31.
