Madras High Court Bench here has restrained officials from insisting upon a 49-year old Head Constable, given compulsory retirement, to vacate his residential quarters as he was underoing dialysis following kidney failure.
Passing interim orders on a petition by N Samidurai, who was asked to go on compulsory retirement in connection with alleged illegal detention of a person in a rape case, Justice S Vaidyanathan said the petitioner should not be disturbed from the residential quarters for two months.
The petitioner contended that he had no role in the detention of the suspect and had been falsely implicated in the case and directed to go on compulsory retirement.
The Judge directed the Director General of Police as well as Ramanathapuram Superintendent of Police to file counters by submitting all relevant documents before the court on July 13.
