The Delhi Court has asked Centre's response on a petition seeking a probe into allegation against an IAS officer that he had furnished wrong informations, including about his nationality at the time of appointment.
Issuing notice to the Home Ministry, a bench of Chief Justice D Murugesan and Justice Jayanth Nath sought its response by May 29 on the petition, filed by one Dileep Kumar Singh Bisht.
Bisht has alleged that Subhash Kumar, a 1977 batch IAS officer, is not a citizen of India and he had concealed the fact at the time of his appointment.
Kumar, presently posted in Uttarakand, is due to retire next year.
"Kumar is a Tibetan refugee who had migrated into India and is not a citizen of India... He managed to get appointment to the prestigious post by supplying wrong informations," the plea said.
Claiming to have obtained details about Kumar through RTI applications, Bisht alleged "for his recruitment to the prestigious Indian Administrative Service, he (Kumar) had submitted false declarations and prepared forged documents including his caste certificate."
Further, the petitioner contended that his parents and family members had migrated to this country and Indian government had granted them the refugee status and the UPSC rules mandates that a person should be Indian citizen for the appointment as IAS.
"Kumar claimed to be from a reserved category of ST and also attached a caste certificate neither bears the seal nor the signature, name, designation and office address of issuing authority...," the plea said.
The petitioner claimed that the officer's original name is Tashi Funchog and he is liable to be disqualified as he is unfit for employment under the Indian government.
He sought the court to direct for an investigation by an independent agency into the allegations.
