A division bench of Justices A S Oka and S S Shinde was hearing a petition filed by Dargah Hazrat Khwaja Mansurul, a dargah located in suburban Bhandup, against Pakistani national Sayyed Waseem-ur-Rehman Shah and others, alleging that Shah is trying to usurp the dargah land from them, even though his role in the dargah is limited to that of a spiritual guide.
Appearing for the petitioners, counsel Rajiv Patil and lawyer Ajit Kenjale submitted that Shah makes inflammatory speeches and following a private complaint before Magistrate's court, the court had directed for registration of FIR against Shah.
When the court was informed that Shah's visa had expired yesterday, it sought to know from the Union government if the visa has been extended.
"The Union government shall say if the visa has been extended and the state government shall say whether under law Shah's presence is required in the country pending trial of the case against him," the bench directed while posting the matter till December 19.
Additional public prosecutor Ajey Gadkari informed the court that the local police through appropriate authorities have informed the Union Home Affairs department regarding the criminal case against Shah, a foreign national.
