Single-judge bench of Justice DP Singh sought response on the election petition filed by one Prabhat Kumar Pandey.
Pandey has alleged that he wanted to contest the by-election as an independent candidate but was kidnapped by workers of the ruling Samajwadi Party which deprived him of the opportunity to file his nomination papers.
The court also issued notice to the District Magistrate concerned and ordered that a reply be furnished within six weeks while the matter be listed for further hearing in the month of November.
Dimple, the wife of Uttar Pradesh Chief Minister Akhilesh Yadav, was elected unopposed to the Lok Sabha seat which had fallen vacant upon the resignation of her husband after he assumed the state's Chief Ministership.
